Welcome to zoshy . These terms and conditions are intended to create a safe and secure place for
companies and general public who choose use and interact with the Zoshy
Privacy to assist and keep Zoshy a safe and secure app.
- Acceptance of terms and conditions: The terms and conditions are the terms on which zoshy offers you
access to the zoshy app and its services.
- Safety
-You will not use Zoshy to do anything unlawful, misleading, malicious, or discriminatory.
-You will not do anything that could disable, overburden, or impair the proper working of Zoshy, such
as a denial of service attack.
-You will not facilitate or encourage any violations of this Statement.
2.SPECIFIC WARNINGS
2.2 At your own risk: Contact between you and businesses enlisted on our app are conducted entirely at
your own risk. You agree that Zoshy takes no responsibility or liability for any misconduct of any of its
members including, without limitation, members that have registered under false pretences or who attempt to
defraud you. Zoshy gives no undertakings, representations, or warranties in relation to the service being
offered on the Zoshy App, including:
a.as to the content, safety, description, worthiness, quality, or legality of the companies that are listed on the My
Namibia App;
c.as to the truth or genuineness of advertisement;
d.that any company listed in the search engine, will meet your requirements or expectations.
2.3 Disclaimer: You clearly understand and agree that:
a.your use of the Zoshy App is at your sole risk. The Zoshy App is just for viewing educational content.
b. responsibility for the content of advertisements appearing on Zoshy App (including hyperlinks to
advertisers' own Apps) rests solely with the advertisers. Each advertiser is solely responsible for any
representation made in connection with its advertisement.
2.4 Breach: Zoshy may disconnect your membership and remove your advertisement if Zoshy s terms
and conditions are breached or if Zoshy feels for any reason you have misused the Zoshy service
inappropriately.
4.GENERAL RULES
4.1 General
a.All advertising or communications made through Zoshy shall be made in good faith.
b.You must not damage, interfere with or harm the Zoshy App or Services, or any network, or system
underlying or connected to them, or attempt to do so.
c.You may not use a robot, spider, scraper or other unauthorised automated means to access the Zoshy
App or information featured on it for any purpose.
d.You must not complete a transaction outside of the Zoshy process or otherwise seek to avoid My
Namibia's success fees. Attempts by you to avoid fees, including through multiple memberships, or otherwise,
may result in Zoshy suspending or terminating your membership at the discretion of Zoshy.
j.You are responsible for any actions taken through your membership. Zoshy memberships are not
transferable and therefore can not be sold, leased, lent or traded
5.FEES AND ACCOUNTS
5.1 Zoshy membership fees:
a.Zoshy charges fees for the use of the Zoshy App as a an advertising site.
b.Zoshy reserves the right to change the fees charged for any of our Services at any time. In the event that
we introduce a fee an email will be sent to all account members. c. If you are a resident, then all fees are
inclusive of GST and in dollars unless otherwise stated. Unless otherwise stated in these terms and conditions,
no interest or other financial charges will be applied to Zoshy account balances.
d. Before listing your company, you should review Zoshy's fees to ensure you are aware of the fees that
you will incur.
e.You must pay the fees immediately upon demand by Zoshy.
5.2 Zoshy Accounts (need to verify how much it costs when a member makes a transaction)
a.Zoshy maintains credit accounts for each member and from which members must pay fees.
c. You must settle any negative account balance immediately. Zoshy reserves the right to take action
against you to recover outstanding debts. You are liable for all expenses (including legal fees) that Zoshy
incurs when collecting that debt.
6.GENERAL PROVISIONS
6.1 System Integrity: Zoshy will use its reasonable endeavours to ensure the availability of the App and
Services, subject to any downtime required for maintenance. However, Zoshy takes no responsibility for
any system unavailability, or for any loss that is incurred as a result of Zoshy App or Services being
unavailable. Further, Zoshy assumes no responsibility for the corruption of any data or information held by
Zoshy.
6.4 Zoshy has no liability for any lack of performance, unavailability or failure of the Services or the
App, or for any failure of Zoshy to comply with these terms and conditions where the same arises from
any cause reasonably beyond the control of Zoshy.
6.5 Partial Invalidity: If any provision of these terms and conditions becomes or is held to be invalid,
unenforceable or illegal for any reason, and in any respect, that provision shall be severed from the remaining
terms and conditions, which shall continue in full force and effect. 6.7 Governing Law: These terms and
conditions are governed by the laws of . You submit to the non-exclusive jurisdiction of the Courts of .
6.8 Intellectual Property Rights: Zoshy (and its licensors or suppliers, as the case may be) owns all
proprietary and intellectual property rights in the App (including text, graphics, logos, icons and sound
recordings) and the software and other material underlying and forming part of the Services and the
7 App.
7.1You may not without our prior written permission, in any form or by any means:
a.Adapt, reproduce, copy, store, distribute, display, perform, publish or create derivative works from any part of
this App; or
ii.Commercialise, copy, or on-sell any information, or items obtained from any part of the Zoshy App.
8. Entire agreement: These terms and conditions supersede all previous conditions, understandings,
commitments, agreements and representations whatsoever whether oral or written, and constitutes the entire
agreement, between the parties, relating to the subject matter of these terms and conditions.
7. REFUND POLICY
If you are not 100% satisfied with our service, within 30 days from the sign up date, we will fully refund the cost of
your order.
8. PRIVACY POLICY
What information do we collect?
We collect information from you when you register on our site, subscribe to our newsletter, respond to a survey or
fill out a form.
When ordering or registering on our site, as appropriate, you may be asked to enter your: name, e-mail address,
mailing address, phone number, credit card information or My Child. You may, however, visit our site
